
Hyderabad, Aug.14 (NSS): The Supreme Court on Wednesday granted relief to the Telangana government in the Governor’s quota MLC’s appointment case. The Supreme Court has stayed the Telangana High Court’s earlier order on the appointment of the MLCs by the State government.
Advocate Kapil Sibal, appearing for the petitioner, sought a status quo for not appointing the new MLCs. The bench made it clear that it cannot stop the Governor from nominating the MLCs. “If the appointment of new MLCs is stopped, the rights of the governor and the government will be taken away. It is the duty of the government to make appointments from time to time,” the court said.
A bench of Justices Vikram Nath and Prasanna Balachandra Vare was hearing a petition filed by BRS party leaders Dasoju Sravan and Kura Satyanarayana challenging the selection of new MLCs under the Governor’s quota in their place. The Supreme Court issued notices to the Governor of Telangana and the State government as the respondents. The bench made it clear that whatever steps are taken by the government and the Governor, it will be subject to the final order of the Supreme Court and adjourned the hearing by four weeks.
During the KCR regime, the appointments of Dasoju Sravan and Kura Satyanarayana as the MLCs were set aside by the then Governor. After the formation of the Revanth Reddy government, Professor Kodandaram and senior journalist Amer Ali Khan were approved by the Governor as the MLCs. Dasoju Shravan and Kura Satyanarayana had approached the High Court alleging that the Governor had acted beyond the purview in their appointment. The High Court stayed the appointment of Kodandaram and Amer Ali Khan. The Supreme Court on Wednesday stayed the High Court verdict.
